• Mismatched information on Vibe System – The tool used by USCIS called Validation Instrument for Business Enterprises(VIBE) validate the information provided by the petitioning employer and if there is an discrepancies between the VIBE system and H1B petition then you may receive a RFE requesting information like the employer’s Federal Tax ID Number, wage reports, lease agreement, financial statements, etc.
• Petitioners who are qualified workers in a “specialty occupation”, the minimum requirement for which is a Bachelor’s Degree or equivalent for the position, are granted H1B visa. USCIS may question the specialty occupation when a petition is only qualified for level 1 wage.
• If the applicant does not have the relevant degree for the position. Those who obtained their degrees overseas are required to provide proof of a foreign degree equivalent.
• If your Bachelor’s degree is not in the same field as your proposed occupation.
• The USCIS evaluates employer-employee relationship to see if it exists in order to approve an H1B petition.
• A worker must show proof that they have maintained status as an employee working in a specialty occupation by submitting pay statements.
